Summary.

The bill amends item 5 of Article 11 of Law 15 of April 28, 1995, concerning the motor vehicle registration form. It proposes requiring the form to state the province, district, corregimiento (district), neighborhood, street, and house, office, or site number of the owner’s declared domicile. For an individual, that domicile must match the one declared to the Electoral Tribunal (Tribunal Electoral); for a legal entity, it must match the information in the Panamá Emprende system of Commerce and Industries. The owner’s domicile determines the district and municipality in which the vehicle would be registered.

The bill allows legal entities with branches or additional offices in the Republic of Panama (República de Panamá) to apply to register their vehicles in the municipalities where those premises are located. They must submit a notice of operation issued by the Ministry of Commerce and Industries (Ministerio de Comercio e Industrias) confirming the extension of their operations. This provision links the place of registration to the documented location of the branch or office, under the conditions governing the registration form.

The National Motor Vehicle Registry Section (Sección Nacional de Registro de Vehículos Motorizados) of the National Directorate of Traffic and Land Transportation (Dirección Nacional de Tránsito y Transporte Terrestre) would issue the vehicle ownership registration once the form meets all established requirements. The bill provides for a single assessment of those requirements: registration in the data processing system could not be authorized if any requirement is unmet. It also requires the vehicle to be registered precisely at the owner’s place of domicile, so that the record falls within the corresponding district and municipality.

The head of the Section must check that the information on the form matches the required documents. A head of the corresponding section who breaches this duty would be subject to the sanctions established in the institution’s internal regulations, without prejudice to any penalty applicable under law. Document verification would therefore be part of the procedure preceding issuance of the vehicle ownership registration.

Upon promulgation, every new motor vehicle registration would be subject to the proposed rules. For vehicles already registered, the transitional provision gives the responsible authorities, entities, and offices one (1) calendar year from promulgation to update their records in accordance with the bill. The proposed law would take effect upon promulgation. Its final article identifies the amendment as a change to item 5 of Article 11 of Law 15 of 1995.

The bill concerns the Electoral Tribunal, the Ministry of Commerce and Industries, the National Motor Vehicle Registry Section, and the National Directorate of Traffic and Land Transportation. Its provisions could interest or affect vehicle owners, businesses with branches or additional offices, municipalities, and services involved in motor vehicle registration and recordkeeping.
