Summary.

The bill amends the Organic Rules of Internal Procedure of the National Assembly (Asamblea Nacional) with respect to family ties among public servants. Article 1 announces the addition of article 230 to the Rules and sets out a provision headed article 230-A. The proposed provision establishes a prohibition concerning where persons falling within the specified degrees of kinship may work. It addresses the organization of the National Assembly’s administrative units and the assignment of public servants to those units.

The prohibition applies to public servants related within the fourth degree of consanguinity or the second degree of affinity. Under the proposed text, persons with such a relationship may not work in the same administrative unit of the National Assembly. The rule concerns the servants’ placement together in a unit, regardless of the functions each performs within it. The stated degrees of consanguinity and affinity define the family relationships covered by the prohibition. The bill thereby introduces a restriction on placing those public servants together within the institution’s administrative structure.

Article 1 also addresses subsequently arising nepotism: a covered family relationship that arises while both public servants are already performing their duties. In that situation, the text provides for the relocation of one of the two servants. The relocation must prevent that person from continuing to work in the same administrative unit as the other servant. It must also prevent the two from serving in units whose functions have a dependency relationship with one another. The proposed measure therefore concerns both continued placement together in one unit and placement in separate units connected through their functions. The text presents relocation as the response to the subsequently arising situation and links it to keeping the two servants’ work assignments separate.

Article 2 provides that the proposed law would take effect upon its promulgation in the Official Gazette. Taken together, the articles propose an addition to the Organic Rules of Internal Procedure and set the point from which the provision would apply. The public institution concerned is the National Assembly: its administrative units and the public servants working in them are directly covered. The subject may be relevant to those responsible for assigning staff within the institution and to public servants whose relationships of consanguinity or affinity fall within the specified degrees.
