Summary.

The bill amends provisions of Law 16 of 1995, which reorganizes the National Sports Institute (INSTITUTO NACIONAL DE DEPORTES). Article 1 replaces Article 15-K to establish the National Anti-Doping Organization of Panama (Organización Nacional Antidopaje de Panamá, ONADPAN). Its stated purpose is to oversee compliance with national and international rules controlling the use of prohibited substances and methods. That purpose also encompasses safeguarding loyalty and fair play in sport while taking the preservation of athletes’ health into account. The provision places the organization within the field of anti-doping control and sets out the aims that would guide its work.

Article 2 replaces Article 15-L and defines three terms for the relevant chapter. It identifies the pharmacological classes and groups of doping agents or methods by reference to those prohibited by the World Anti-Doping Agency (Agencia Mundial Antidopaje). It defines “doping in sport” as any violation of anti-doping rules found in Article 2 of the current World Anti-Doping Code (Código Mundial Antidopaje). Its definition of “doping” covers the commission of one or more violations of the anti-doping rules set out in that same article of the current World Anti-Doping Code. These definitions connect the proposed national provisions to the prohibitions and anti-doping rules expressly referenced in the bill.

Article 3 replaces Article 15-M and describes who would commit doping under the proposed provision. It covers a person who uses prohibited substances or means, or methods that do not comply with the rules, in training or before, during or after a sporting competition. It also covers a person who facilitates, supplies or encourages the practice of doping and hinders its control. The provision thus addresses use at the specified stages of training and competition, as well as facilitation, supply and encouragement accompanied by interference with doping control.

Article 4 provides for amendment of Articles 15-K, 15-L and 15-M of the Consolidated Text of Law 50 of 2007, which amends Law 16 of 1995. Article 5 provides that the proposed law would take effect on the day following its promulgation. Given its subject matter, the bill concerns the National Sports Institute (INSTITUTO NACIONAL DE DEPORTES), the National Anti-Doping Organization of Panama (Organización Nacional Antidopaje de Panamá) and the World Anti-Doping Agency (Agencia Mundial Antidopaje); it could interest or affect athletes and people involved in training, sporting competitions and doping control in Panama.
