Summary.

Article 1 proposes to approve in full the Protocol relating to an amendment to Article 50 a) of the Convention on International Civil Aviation. Signed in Montreal on October 6, 2016, the protocol records the decision of the Assembly of the International Civil Aviation Organization (ASAMBLEA DE LA ORGANIZACIÓN DE AVIACIÓN CIVIL INTERNACIONAL) at its thirty-ninth session in Montreal. It refers to the Convention concluded in Chicago on December seventh, nineteen forty-four, and states the aim of broadening the representation of contracting States on the Council. The proposed amendment accordingly replaces “thirty-six” with “forty” in the second sentence of Article 50 a) of the Convention.

Under Article 94 a) of the Convention, the protocol sets the number of contracting States whose ratification is required for the amendment to enter into force at one hundred and twenty-eight. It directs the Secretary General of the International Civil Aviation Organization (Organización de Aviación Civil Internacional) to draw up the protocol in Spanish, Arabic, Chinese, French, English and Russian, with each text equally authentic. It also provides for signature by the President and Secretary General of the Assembly. Ratification is open to States that have ratified or acceded to the Convention on International Civil Aviation. Instruments of ratification are to be deposited with the International Civil Aviation Organization.

For States that have ratified it, the protocol enters into force on the date the one hundred and twenty-eighth instrument of ratification is deposited. For a contracting State that ratifies after that date, it enters into force upon deposit of that State’s instrument. The Secretary General must immediately inform all contracting States of the date on which each ratification is deposited and must immediately notify them of the protocol’s date of entry into force. The protocol is deposited in the archives of the International Civil Aviation Organization. Its Secretary General transmits certified copies to all contracting States of the Convention concluded in Chicago.

Article 2 provides that the approving law would take effect upon its promulgation. The amendment contained in the approved instrument concerns the composition of the Council established by the Convention; its effect follows the protocol’s rules on ratification and entry into force. The bill concerns the International Civil Aviation Organization and its contracting States. Its subject matter may also be of interest to public authorities responsible for foreign relations and civil aviation, and to the air transport sector.
