Summary.

Article 1 proposes approval in full of the Protocol Relating to an Amendment to Article 56 of the Convention on International Civil Aviation, signed in Montreal on October 6, 2016. The Convention addressed by the Protocol was made in Chicago on the seventh day of December 1944. The Assembly of the International Civil Aviation Organization (ASAMBLEA DE LA ORGANIZACIÓN DE AVIACIÓN CIVIL INTERNACIONAL) adopted the proposed amendment during its thirty-ninth session after considering the contracting States’ wish to increase the membership of the Air Navigation Commission (Comisión de Aeronavegación). The amendment replaces “nineteen members” with “twenty-one members” in Article 56 of the Convention. The Protocol bases this action on Article 94(a) of the Convention.

Article 1 also incorporates the Protocol’s ratification arrangements. Ratification by one hundred and twenty-eight contracting States is required for the amendment to enter into force. The Protocol is open to ratification by any State that has ratified or acceded to the Convention on International Civil Aviation. Instruments of ratification are deposited with the International Civil Aviation Organization (Organización de Aviación Civil Internacional). For States that have ratified it, the Protocol enters into force on the date the one hundred and twenty-eighth instrument is deposited. For each contracting State ratifying after that date, it enters into force when that State deposits its own instrument with the Organization.

The Protocol directs the Secretary General of the International Civil Aviation Organization to notify all contracting States immediately of the date of deposit of each ratification and of the date on which the Protocol enters into force. It also provides for texts in Spanish, Arabic, Chinese, French, English, and Russian, each equally authentic. The Protocol provides for signature by the President and the Secretary General of the Assembly, deposit of the single document in the Organization’s archives, and transmission of certified copies to all States party to the Convention.

Article 2 provides that the approving law would take effect upon its promulgation. The bill concerns the International Civil Aviation Organization, its Assembly, and the Air Navigation Commission. It would affect States party to the Convention and may be of interest to the international civil aviation sector and participants in air navigation.
