Summary.

The bill provides for the repeal of legal provisions concerning special retirement benefits for the public security forces and security branches under the Ministry of Public Security (Ministerio De Seguridad Pública). It then amends paragraph 1 of article 56 of Law 93 of 2013, which reorganizes the National Aeronaval Service of the Republic of Panama (Servicio Nacional Aeronaval de la República de Panamá). For its members, it establishes completion of thirty years of continuous service as a ground for retirement. It links the right to receive a retirement benefit to Law 51 of December 27, 2005, as amended, which reforms the Organic Law of the Social Security Fund (Caja de Seguro Social).

Article 3 amends paragraph 1 of article 99 of Law 18 of June 3, 1997, the organic law governing the National Police (Policía Nacional). The proposed provision recognizes completion of twenty-five years of consecutive service or thirty years of non-continuous service in the institution as grounds for retirement. It also refers the right to receive the benefit to Law 51 of December 27, 2005, as amended. In identifying legislation connected with this provision, the bill mentions Executive Decree 172 of July 29, 1999, which implements chapters of Law 18 of June 3, 1997, and Decree-Law No. 8, which creates the National Border Service of the Republic of Panama (Servicio Nacional de Fronteras de la República de Panamá).

Article 4 repeals article 363 of Executive Decree 172 of July 29, 1999, concerning the implementation of chapters of Law 18 of June 3, 1997. Article 5 then amends paragraph (a) of article 101 of Decree-Law 2 of 1999, the organic law of the Institutional Protection Service (Servicio de Protección Institucional). For members of that service who belong to the police career, it makes completion of thirty years of continuous service in the institution a ground for retirement and refers the benefit to Law 51 of December 27, 2005, as amended.

Article 6 establishes for the public security forces and security branches under the Ministry of Public Security a retirement benefit governed by Law 51 of December 27, 2005, as amended. Article 7 provides that members of the aeronaval and institutional protection services, the National Police, and all other security branches who hold special retirement benefits under Law 93 of 2013 and Law 18 of 1997 before the bill takes effect are entitled to an amount corresponding to their last salary earned. Article 8 sets commencement in the fiscal year following promulgation.

The provisions concern the Ministry of Public Security, the National Aeronaval Service of the Republic of Panama, the National Police, the Institutional Protection Service, the National Border Service of the Republic of Panama, and the Social Security Fund. They could affect their members, other security branches, and administrators of retirement benefits.
