Summary.

The draft bill seeks to amend Law 42 of August 27, 1999, concerning equal opportunities for persons with disabilities. Its provisions address renewal of the disability card and the registration of every condition reported by applicants with multiple disabilities. To that end, it proposes adding two articles to the law and assigns duties to the State, the Ministry of Health (Ministerio de Salud), and the National Secretariat for Disability (SENADIS).

Art. 2 adds Article 15A to Chapter I, Health, Comprehensive Habilitation and Rehabilitation, of Law 42 of August 27, 1999. It directs the State, acting through the Ministry of Health in coordination with SENADIS, to establish an expedited procedure for renewing the disability card. The procedure must ensure that renewal takes no longer than 30 business days. In urgent cases, mechanisms for immediate renewal would be implemented so that persons with disabilities retain continuous access to essential services while their cards are being processed.

Art. 3 adds Article 16A to Chapter IV, Access to the Physical Environment and Means of Transportation, of the same law. It directs SENADIS to develop and put into operation a specific format within the disability card application form. That format would allow persons with multiple disabilities to register all their conditions so that their health status or multiple disabilities are represented in the application process. The article also provides for the training and awareness of staff responsible for registering and renewing disability cards, with the aim of ensuring appropriate and efficient treatment of applicants.

Art. 4 directs the State, through SENADIS and in coordination with the Ministry of Health, to update the administrative systems and procedures used to receive and process information about multiple disabilities. The updates must support the inclusion and proper processing of that information and prevent persons with multiple disabilities from encountering additional barriers when accessing their rights and benefits. Art. 5 expressly records the addition of Articles 15A and 16A to Law 42 of August 27, 1999. Art. 6 provides that the proposed law would take effect on the day following its promulgation.

The public bodies involved through the responsibilities assigned in the text are the Ministry of Health and SENADIS. The provisions could concern or affect persons with disabilities, particularly those with multiple disabilities; personnel who process disability card applications and renewals; and essential services to which the card facilitates access.
