Summary.

The bill seeks to amend Law 27 of May 23, 2017 to extend paternity leave for private company employees and public servants. Its provisions set the length of ordinary paternity leave and add paid leave linked to a child's hospitalization in a neonatal care unit. Both measures would be incorporated through amendments to that law.

Article 2 amends article 3 of Law 27 of May 23, 2017 and sets paternity leave at ten (10) working days. Those days would count as time in effective service. During the leave, the beneficiary could not work for another employer or on their own account. The provision would apply to employees of private companies and to public servants covered by the bill's stated purpose.

Article 3 adds article 3-A to Law 27 of May 23, 2017. The new provision would grant the father one (1) additional paid working day for each full day that the child is hospitalized in a neonatal care unit, up to a maximum of five (5) working days. Eligibility is tied to hospitalization occurring within twenty-eight (28) days after birth. The additional days would also count as time in effective service. While taking this leave, the beneficiary could not work for another employer or on their own account.

The hospitalization leave would be separate from, and additional to, the ordinary paternity leave provided for in article 3. The father could take it continuously or in separate periods within thirty (30) days after the child's discharge from hospital. To obtain the leave, he would have to present a medical certificate issued by the hospital where the child receives care. The added article therefore links the duration of the leave to full days of hospitalization and specifies the document required for it to be granted.

Article 4 assigns the Executive Branch (Órgano Ejecutivo) responsibility for issuing implementing regulations within six (6) months. Article 5 expressly identifies the changes to Law 27 of May 23, 2017: amendment of article 3 and addition of article 3-A. Under article 6, the proposed law would take effect upon its promulgation in the Official Gazette. Its subject matter concerns the Executive Branch, hospitals that would issue medical certificates, private companies, public servants, fathers eligible for leave, and their children.
