Summary.

The draft bill establishes mandatory use of megatrucks to transport vehicles imported into the country. The journey covered runs from the port where the vehicles arrive to the premises of motor vehicle dealers, distributors, or importers. The obligation concerns the means used to carry out that transfer between the vehicles’ point of arrival and the specified operators’ premises. Article 1 thus identifies both the vehicles covered and the route on which a megatruck would be required.

For vehicles imported for sale in the Republic of Panama (República de Panamá), Article 2 prohibits their circulation by dealers, distributors, or importers if those operators have not contracted a megatruck service to take them to their premises. The provision ties the prohibition on circulation to the contracting of the service for that transfer. It addresses operators receiving imported vehicles for sale and identifies the premises of motor vehicle dealers, distributors, or importers as the destination. Contracting a megatruck is therefore stated as a condition for moving those vehicles from their arrival point to those premises.

Article 3 adds a condition governing circulation of vehicles by authorized motor vehicle dealers, distributors, or importers. They would be unable to circulate a vehicle without first obtaining the single circulation license plate issued by the relevant Municipality where the vehicle has been registered. The rule links that plate to the municipality of registration and applies to circulation of vehicles by the authorized operators. This requirement appears alongside the obligation to use megatrucks for transport from the port and the prohibition on circulating vehicles imported for sale without contracting that service.

Article 4 requires megatrucks to meet the conditions established by Law 51 of June 28, 2017 (ley 51 de 28 de junio de 2017), which regulates road freight transport. The transport vehicle required for the transfer would consequently be subject to the conditions set out in that road freight law. The draft bill refers to that law for the conditions applicable to megatrucks and does not amend its provisions. Article 5 sets the proposed law’s commencement for the day after its promulgation.

The public bodies connected with the proposal are the municipalities that issue the single circulation license plate in the place where a vehicle is registered. Sectors that could be interested in or affected by its provisions include motor vehicle dealers, distributors, and importers, as well as providers of megatruck services and road freight transport.
