Summary.
The bill would add provisions to Law 66 of October 29, 2015 to connect community projects funded through decentralization with technical training. Under proposed Article 78-A, community boards and municipalities could coordinate with the National Institute for Vocational Training and Human Development (Instituto Nacional de Formación Profesional y Capacitación para el Desarrollo Humano, INADEH) to facilitate participation by people who have completed, or are undertaking, technical training. Their participation would have to relate to the project’s technical nature, meet the required suitability criteria, and comply with applicable labor, administrative and budgetary rules.
Proposed Article 78-B would allow INADEH, in coordination with municipalities and community boards, to promote supervised placements, technical learning, community assistance and other training experiences linked to projects carried out with decentralization funds. Participation would be governed by the applicable agreements, regulations and provisions. Participation alone would not create a permanent employment relationship with the public entity concerned.
Proposed Article 78-C would allow INADEH to establish digital search mechanisms through which municipalities and community boards could learn what trained people are available in each district or corregimiento (district). Those mechanisms would have to comply with rules on personal data protection and access to public information. The information supplied would be for guidance only and would not create an obligation to hire anyone.
Proposed Article 78-D would allow the National Decentralization Authority (Autoridad Nacional de Descentralización), INADEH, municipalities and community boards to enter into cooperation agreements. These could support training programs, technical assistance, practical training and the development of local capabilities linked to community projects. Proposed Article 78-E would then require local authorities, when planning such projects, to seek opportunities to include technical skills available in the relevant corregimiento or district. Doing so would depend on compatibility with the project’s objectives, the availability of qualified personnel and the applicable rules.
The National Decentralization Authority and the National Institute for Vocational Training and Human Development would prepare technical guidelines within six months after the law enters into force. The Executive Branch would issue implementing regulations within six months after its promulgation. The text also identifies proposed Articles 78-A through 78-E as additions to Law 66 of October 29, 2015 and provides that the law would take effect on the day after its promulgation. The proposal concerns those institutions, municipalities and community boards, and could be of interest to technical trainees, local technical workers and communities where projects funded through decentralization are carried out.
