The bill establishes a simplified probate procedure before a notary public, implementing Article 703 of Law 402 of 8 August 2023, which adopts the Code of Civil Procedure, and in line with the Civil Code on testate and intestate succession. Estates could be processed before a notary when all heirs are adults and there is no dispute among them, or when the deceased left a will and all heirs agree with its content. The law would be special notarial legislation for uncontested succession proceedings. The statement of reasons gives as its aims relieving court congestion and reducing the cost and time of judicial probate proceedings.
